the gospel of luke not state herod did not condemn jesus, , instead attributes conclusion pilate calls jewish elders, , says them:



i having examined him before you, found no fault in man touching things whereof ye accuse him: no, nor yet herod: sent him unto us; , behold, nothing worthy of death hath been done him.

after further conversations between pilate , jewish elders, jesus sent crucified on calvary.
